The Office for Nuclear Regulation (ONR) has notified Bouygues Travaux Publics and Laing O’Rourke that they will be prosecuted following a rebar mesh wall accident at the Somerset nuclear construction site.

The charges relate to an incident that occurred on 20th August, 2022, in a pre-fabrication yard on site. An employee sustained serious injuries when a wall of rebar mesh fell upon him as he was working to remove the rebar from a vertical jig to be transferred to another part of the site.

Bouygues Travaux Publics SAS and Laing O’Rourke Delivery Limited each face a single charge of failing to plan, manage and monitor construction work without risks to health and safety, in contravention of Section 33(1)(c) of the Health and Safety At Work Etc. Act 1974.

Bouygues Travaux Publics and Laing O’Rourke are the two companies in the Bylor joint venture that is the main contractor at Hinkley Point C.

News of this prosecution comes just a few weeks after the ONR announced it was prosecuting the two companies, along with client body NNB Generation Company (HPC) Ltd, over the death of site supervisor Jason Waring, 48, who was crushed by moving machinery on site in November 2022.

And it was only three months ago that ONR issue NNB GenCo an improvement notice relating to the monitoring and management of tower cranes following the failure of components spotted by an operator during routine pre-use checks in February.

Dates of court hearings have yet to be determined.

In response to the latest ONR decision, a spokesperson for Bylor said:

“We have been informed by the Office for Nuclear Regulation of its intention to bring a prosecution in relation to an incident that occurred on the Hinkley Point C site on 20 August 2022. We await the detailed findings and the specific legal basis for the proposed action, which we understand will be communicated separately. We continue to cooperate fully with the regulator.â€
