The Contracting Authority does not intend to include a sub-contract clause as part of community benefits (as per Section 25 of the Procurement Reform (Scotland) Act 2014) in this contract for the following reason:
Most of the supply base are micro or SMEs, and the application of the Sub-Contract Clause may deter contractors from bidding for requirements. Contractors who intend to sub-contract out any portion of the works will be required to provide sub-contractor SPDs for all proposed sub-contractors who will be relied upon to deliver the works. The acceptance of any subcontractor(s) will be subject to the approval of FLS.
The Contracting Authority does not intend to include any community benefit requirements in this contract for the following reason:
Community benefits were considered and are not directly related to the type of works required. Given that a contractor can win a maximum of 4 lots, with up to 3 contractors in each Lot, it is highly unlikely that we would spend 4,000,000 GBP with a contractor over the 4-year duration. It was decided not to include community benefits given the current economic climate and to ensure that the process is not too onerous for smaller contractors.
